Terms and Conditions

Description of Goods
We describe our products as accurately as we can. Any error or omission in any information on the site or document issued by us shall be corrected provided that the correction does not materially affect the Contract of Sale. We or our suppliers may, from time to time and without notice, change the Goods in order to comply with any applicable statutory requirements provided that such changes do not materially affect the nature or the Price of the Goods.

All of our products have all been chosen for their suitability for the allergy market but unfortunately we cannot guarantee that all our products are suitable for all customers since sensitivities are so individual. Please be sure to check all ingredients on the packet or bottle before opening as opened products cannot be returned.

If the products ordered by you are not available, we will contact you and offer you the option of either ordering alternative Goods or cancelling your order. If we are unable to contact you within 28 Working Days the Contract will be deemed cancelled and any sums you have already paid to us in respect of the Goods ordered will be refunded in full.

Postage
Our delivery charges are  broken down into:

1. Standard Delivery (£4.50) which covers postage and packing from orders being sent from our offices at The Healthy House. Most orders are sent out within two to three days. We will email you your shipping details once your order has been sent out. Delivery is calculated in your basket.*
2. Direct Delivery applies to paint and other products that come directly from one of our suppliers. There are some rental products that also incur a Direct Delivery charge that may come from The Healthy House offices. These charges will show up in your basket. Products with a Direct Delivery charge are not eligible to be upgraded to Next Day.
3. Next Day Delivery is a matter of choice. If you order before 12 noon and choose Next Day Delivery your order will be sent out the same day and delivered the next day to mainland UK.*

* Standard Delivery and Next Day charges to the following postcodes including the Highlands and Islands of Scotland, Northern Ireland and anywhere off mainland Britain may be increased. This includes the following postcodes:  FK17-99, G83, HS1-9, IV1-28, IV33-51, IV55-56, KA27-28, KW all, PA20-48, PA60-78, PH18-26, PH30-44, TR21-TR25, ZE1-3, BT all, IM all, JE all, GY all. We will notify you if your order incurs any increased charges. Because this cannot be automated at the Check Out your order will be confirmed at the £4.50 or £7.50 rate and you will be notified of the real charge before your order is processed. The Next Day Delivery to these areas is actually a 48 hr (2 day) delivery.

We do not deliver to America or Canada but will be happy to deliver to an address of your choice in the UK for onward shipment to North America.Charges to the Islands and Highlands of Scotland, Northern Ireland and anywhere off the mainland may incur an extra charge if your order needs to be sent via courier. We will notify you by email or phone if this is the case.

Delivery Charges for Paint
All paint is mixed up to order. If you are ordering a large amount of paint, we suggest you order cautiously as paint may not be returned.

The delivery charge on paint and all Ecos products is £9.60 for 1-15 litres, £19.20 for 16-30 litres and £28.80 for 31-45 litres. If you are ordering more than 45 litres the additional charge will be £9.60 for every 1-15 litres. The delivery charge will be calculated automatically at the Check Out.  However, if you require delivery to the Scottish Highlands, Northern Ireland or anywhere off the mainland, we will advise you of the delivery charge before ordering your paint. Please allow 3-4 working days for delivery although most orders will arrive in 24-48hrs. Please remember to order carefully as paints are mixed up to order and cannot be returned. 

Delivery 
Most orders are despatched within a few days and many go out within 24 hours of ordering. Unfortunately we are unable to guarantee the time of delivery and cannot accept responsibility for delays that are beyond our control. If you require goods to arrive at a specific time, please make sure you order well in advance. If you fail to collect your package or fail to arrange for it to be redelivered it will be returned to us and we will be charged for this return. Once we have received the uncollected package we will inform you, usually by email and ask you how you would like it resent. We will charge you for the original posting and the returns fees (typically £6.99 each way for one parcel). Our prices include postage from us to you one time only. We must be notified of receipt of damaged goods immediately as claims must be made promptly.

Guarantee and Returns 
We want you to be delighted with your purchase but understand that sometimes you may need to return a product. You can order with complete confidence as we guarantee to refund or exchange any product that you are not completely happy with (goods that are made up to order are non-returnable unless faulty; this includes mattresses and paint). All we ask is that you return the product to us in its original unused condition, in its original undamaged packaging.  It is your responsibility to take “reasonable care” of the goods.  Please note that goods that are made or mixed up to order are non returnable unless for faulty workmanship. 

Returns within 14 days 
Items may be returned within 14 days of receipt of order. The cost of the goods but not the postage will be refunded. We reserve the right to charge a restocking charge and to charge for any goods not returned in saleable condition or exceeding the 14 day period. Please notify us before returning goods and use the returns form enclosed with your order. Please notify us immediately of faulty or damaged goods to discuss method of return otherwise we regret we are unable to accept responsibility for return charges. If a product fails after 14 days, we will need the product returned to us for inspection prior to a replacement being sent.

Returns within 7 days 
Within 7 days of receipt of your order you have the right to notify us in writing and return the whole order in its original undamaged packaging (goods that are made up to order are non-returnable unless faulty; this includes mattresses and paint). We will refund the full purchase price and postage. It is your responsibility to cover the cost of returning the goods and to insure them for their value in case they should go astray or be damaged in transit. This does not affect your statutory rights. 

Price
The Price to be paid by you is that displayed on the Site at the time when your order is received by us. In the event that we discover a genuine error in the Price for the Goods ordered by you as displayed on the Site, we shall notify you as soon as possible providing you the option of either reconfirming the order at the correct Price or cancelling the order. If we are unable to contact you for the purposes within 10 Working Days or if you fail to either reconfirm or cancel the order within this period, your order will be deemed to be cancelled and any payment will be refunded in full.

All Prices are quoted inclusive of VAT unless otherwise stated and in pounds sterling.

Payment
Payment for the Goods is due at the time of placing your order, payment is to be made on our Secure Site by one of the following credit or debit cards: MasterCard, Visa, Maestro or Solo. Payment will be taken when your order is processed and prior to despatch.

Risk and Title of Goods
Risk of damage to or loss of the Goods shall pass to you at the time of delivery to the Delivery Address. If the goods are delivered to you and you refuse delivery then risk shall pass to you at the time when we have tendered delivery of the Goods, but you shall not be responsible for any damage to the Goods caused by our negligence.

Ownership of the Goods shall pass to you once they have been fully paid for and on delivery.

Liability
Nothing in these Conditions excludes or limits our liability for negligence. We shall not be liable for any losses under the Contract which were not foreseeable to us at the time when the Contract was made and/or relate to any business undertaken by you and/or were not caused by any breach of the Contract by us or our employees.

Force Majeure
We shall be not liable to you or deemed to be in breach of this Sales Contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the Sales Contract, if the delay or failure was due to any cause beyond our reasonable control such as (but without limitation) any strike, lock-out or other form of industrial action, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of supplier or sub-contractors or inability to obtain materials required for performance of the Sales Contract.

Third party rights
A person who is not a party to the Contract will not have any rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999.

Severance
If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions shall remain in full force and effect.

Waiver
If either you or us fail or delay or compromise in exercising a right or remedy under the Contract, the right or remedy is not to be treated as having been waived, restricted or varied and any agreement by either you or us to refrain from exercising a right in one particular instance will not prevent you or us from exercising it in full in the future.

Cumulative Remedies
All rights and remedies available to either you or us under the terms of the Contract or under the general law are to be cumulative, and no exercise by either you or us of any such right or remedy is to restrict or prejudice the exercise of any other right or remedy granted by the Contract or otherwise available to you or us.

Governing Law and Jurisdiction
The Contract shall be governed by the laws of England and Wales and any court proceedings in relation to the Contract are to be brought in the English Courts.
